TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MUNKONGTECH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • (a) Your use or inability to use our Services
  • (b) Any unauthorized access to or use of our servers and/or any personal information stored therein
  • (c) Any interruption or cessation of transmission to or from our Services
  • (d) Any bugs, viruses, trojan horses, or similar that may be transmitted through our Services
  • (e) Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING OUR SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:

  • Non-payment of fees
  • Suspected fraudulent, abusive, or illegal activity
  • Upon request by law enforcement or government agencies

11.3 Effect of Termination

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

At our sole discretion, we may require any dispute to be resolved through binding arbitration in accordance with the rules of the Thailand Arbitration Center.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect.

Your continued use of our Services after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our Services.
